Refund and Payment Cancellation Terms
Refund procedure for digital VPN services provided by EvilFox.Win. This document takes into account mandatory EU rules (Directive 2011/83/EU, Regulation (EU) 2019/770) and US rules (state consumer rights, FTC). The reference framework is EU/US law, not authoritarian jurisdictions.
1. Digital nature of the service
The service is digital content, not supplied on a tangible medium, provided remotely and, as a rule, instantly after payment (see delivery).
2. Right of withdrawal — EU consumers (14 days)
If you are a consumer in the European Union, you may have the right to withdraw from a distance contract within 14 calendar days without giving reasons (Directive 2011/83/EU).
Exception for digital content: if at purchase you explicitly requested immediate commencement of the service and received access (configuration in your account), the right of withdrawal may be lost to the extent of the service already provided (Art. 16(m) of the Directive). Details — in the offer, Section 7.
Before use begins (access not activated/connected), a refund may be considered upon request to support within a reasonable time.
3. US consumers
For consumers in the United States, a refund of digital services with instant delivery after actual receipt of access is not provided, except in cases of an erroneous charge or duplicate payment, or where a refund is mandatory under the law of the state of residence. Receipt of access means issuance of the configuration and/or subscription link in the account dashboard.
You may stop using the Service at any time (voluntary cancellation). The unused remainder of the prepaid period is not refundable.
Personal data matters — per the privacy policy (CCPA/CPRA for California residents).
4. Refund before use
A refund request for unused access may be considered via support or contacts. Refund is not guaranteed automatically and depends on the technical capability of the payment provider.
A refund may be denied for violations of site rules, VPN rules, or for causing significant harm to the service (see the offer).
5. Erroneous payment and chargeback
In case of an erroneous transfer or duplicate charge, contact support with the transaction number, amount, and payment method. Upon confirmation of the error, funds are returned per the payment system's procedures.
Do not abuse chargebacks without grounds — this may result in account suspension.
6. Refusal of refund
A refund for the unused remainder of a prepaid period is not issued, except as expressly provided by this policy or mandatory EU/US law. A refund is also not issued if access has already been used (connection via issued credentials, activation of the configuration). Permanent suspension for violations — see site rules.
Serious violations that result in refusal of a refund and blocking of access include, without limitation:
- using the Service for unlawful purposes, including distribution of child sexual abuse material (CSAM/CSE), cyberattacks, phishing, malware distribution, and fraud;
- exceeding the tariff device limit;
- transferring access to third parties for commercial purposes;
- other material violations of the offer, site rules, and VPN rules, as well as EU/US law.
Commercial use
Commercial use of the Service (resale of access, use for business purposes, providing access to third parties for a fee) is permitted only with the Provider's written permission.
Use of the Service for commercial purposes without such permission is a breach of the offer and this policy and results in blocking of access without a refund.
7. Government and network-level blocks
VPN restrictions imposed by governments, providers, or telecom operators (including mass blocks in certain countries) are circumstances beyond the service's control and in themselves do not constitute grounds for a refund if the service was technically provided on our side. You independently assess risks in your location (see VPN rules).
8. Unavailability due to service fault
A refund for the subscription period may be considered if server downtime due to service fault exceeded 3 consecutive calendar days, access was not restored by server replacement, and you promptly notified support. Brief outages and scheduled maintenance are not grounds.
For EU consumers, rights for non-conforming digital content under Regulation (EU) 2019/770 are preserved — to the extent applicable.
9. Request review timeframes and refund method
Review of a refund request — up to 14 business days from receipt of a complete set of details (transaction number, amount, payment method, description of the grounds). Upon approval, refund via the same payment method; crediting time — per payment system rules (typically 10–30 business days).
GDPR data-subject requests, including deletion of personal data, are reviewed separately from refund requests — without undue delay and in any event within one month (typically up to 30 calendar days) under Art. 12(3) GDPR. Granting a data-deletion request does not in itself mean a refund of payment.
10. Disputes (EU / US)
Disputes — via support. EU consumers: ODR platform. Mandatory rules of your country of residence are preserved (see the offer, Section 16).
11. Account deletion and data (GDPR)
The Customer may delete their account at any time via the account dashboard (deletion form with password confirmation). This implements the right to erasure (“right to be forgotten”, Art. 17 GDPR). Account deletion results in deletion of related personal data (email, traffic information, connection logs, if stored), except information the Provider is required to retain under tax and accounting law (including payment history and transaction amounts). Such information is stored in anonymized form (without a link to email or a profile) and is used solely to meet legal obligations (Art. 17(3) GDPR), typically for 5–7 years. The Provider does not intentionally analyze or store VPN traffic content. Residual personal data in backups is overwritten within the periods stated in the privacy policy.
Account deletion is not grounds for a refund of the unused subscription period (see section 6). After account deletion, restoration of access is not possible.
Data-deletion requests are also accepted via support (admin@evilfox.cc) and are processed without undue delay within 30 calendar days (one month) under Art. 12(3) GDPR. Granting a deletion request does not in itself mean a refund of payment.
